1. Acceptance of the Terms
Welcome to Paisa Tours RD. By accessing and using our website paisatoursrd.com, booking any tour or excursion, or contracting our tourist services, you ("the Client", "you" or "your") agree to be legally bound by these Terms and Conditions ("Terms").
If you do not agree with any part of these Terms, please do not use our services.
Paisa Tours RD ("we", "our" or "the Company") is a tour and excursion agency operating legally in the Dominican Republic, specializing in tourist services in Punta Cana and throughout the Dominican territory.

3. Services Offered
Paisa Tours RD offers the following tourist services in the Dominican Republic:
3.1 Tours and Excursions
- Shared or private group tours
- Full-day or half-day excursions
- Water tours, adventure, cultural and ecological tours
- Visits to natural attractions and historical sites
3.2 Included Services
Our tours typically include:
- Round-trip transportation to/from your hotel
- Certified tour guide (Spanish/English)
- Tickets to parks and attractions
- Typical Dominican buffet lunch
- Drinks during the tour (water, soft drinks, rum depending on the tour)
- Required equipment (snorkel, life jackets, helmets as appropriate)
- Travel insurance and assistance
3.3 Services Not Included (unless otherwise specified)
- Tips for guides and staff (optional but appreciated)
- Professional photographs (available for purchase)
- Additional alcoholic beverages not included
- Souvenirs and personal purchases
- Services not specified in the tour description
4. Reservations and Confirmation
4.1 Booking Process
- Reservations can be made through our website, WhatsApp, email or phone
- All reservations require full name, email, phone number and hotel of accommodation
- The reservation is NOT final until written confirmation is received from Paisa Tours RD
- You will receive an email confirmation with tour details and pickup time.
4.2 Availability
- All tours are subject to availability
- We reserve the right to refuse reservations without needing to provide a reason.
- For large groups (+10 people) a reservation is required at least 48 hours in advance.
- Some tours have limited spaces and operate on a "first come, first served" basis.«
4.3 Required Information
You must provide accurate and complete information:
- Full names of all passengers
- Ages (important for tours with restrictions)
- Exact name of the hotel and location
- Contact number available during your stay
- Special needs, medical or dietary restrictions
4.4 Collection Confirmation
- The exact pick-up time will be confirmed 24 hours before the tour.
- Pick-ups at hotels in Punta Cana, Bavaro, Uvero Alto and Cap Cana are included
- An additional charge may apply to accommodations outside of main tourist areas.
5. Prices and Payments
5.1 Prices
- All prices are expressed in US Dollars (USD)
- Prices include applicable Dominican Republic taxes
- Prices shown are per person, unless otherwise stated
- We reserve the right to change prices without prior notice
- The applicable price is the one in effect at the time of booking confirmation.
5.2 Accepted Payment Methods
- Credit/debit cards (Visa, Mastercard, American Express)
- PayPal
- Bank transfer
- Cash payment (USD or Dominican Pesos at the exchange rate of the day)
- Payment in person at our offices
5.3 Payment Policy
- Regular tours: Full payment required at time of booking
- Private tours or groups: Deposit of 50% upon booking, balance due 48 hours before the tour
- Last minute bookings: Full payment required immediately
5.4 Payment Security
- We use secure and certified (SSL) payment processors
- We do not store complete credit card information
- All transactions are protected by encryption.
5.5 Receipts and Billing
- You will receive an electronic receipt by email after each payment
- Invoices with RNC available upon request
- For business billing, please provide tax information at the time of booking.
6. Cancellation and Refund Policy
6.1 Cancellations by the Customer
Cancellation with 48+ hours' notice:
- Refund of the 100% amount paid
- Refund processing within 5-7 business days
Cancellation within 24-48 hours:
- 50% Refund of the amount paid
- Or a 100% credit valid for 6 months for another tour
Cancellation with less than 24 hours' notice:
- No refund
- Option to reschedule with charge of 30% (subject to availability)
No-show:
- No refund or rescheduling
6.2 How to Cancel
To cancel your reservation:
6.3 Cancellations by Paisa Tours RD
If we have to cancel a tour for operational reasons:
- Full refund of 100%
- Or rescheduling at no extra charge
- Notification at least 24 hours in advance (except in emergencies)
6.4 Cancellations due to Force Majeure
In the event of hurricanes, tropical storms, earthquakes, civil unrest, pandemics, or other circumstances beyond our control:
- The tour will be rescheduled free of charge
- Or credit valid for 12 months will be offered
- We are not responsible for travel expenses or other associated costs
6.5 Climatic Conditions
- Tours may be modified or canceled due to bad weather to ensure safety.
- In case of light rain, most tours continue as normal.
- Cancellations due to extreme weather offer rescheduling or a full refund.
- The final decision on climate safety is made by our operations team.
7. Modifications and Reprogramming
7.1 Changes by the Customer
- Date changes are allowed up to 48 hours in advance free of charge.
- Changes made less than 48 hours in advance are subject to availability and a 20% charge.
- Changes to the number of passengers must be notified 24 hours in advance.
- Passenger reductions with less than 24 hours' notice do not generate a partial refund
7.2 Changes by Paisa Tours RD
We reserve the right to:
- Modify itineraries for safety or operational reasons
- Change tour guides based on availability
- Adjust collection times (with prior notification)
- Replace attractions with equivalent alternatives if necessary
8. Tour Requirements and Restrictions
8.1 General Requirements
- Minimum and maximum age according to the specifications of each tour
- Adequate physical condition for tour activities
- Presentation of valid identification when required
- Compliance with instructions from guides and security personnel
8.2 Health and Safety Restrictions
People with the following conditions are NOT eligible to participate:
- Pregnant women (on adventure tours)
- Serious heart problems (physically demanding tours)
- Recent surgeries or unhealed injuries
- Under the influence of alcohol or drugs
- Medical conditions that put your safety at risk
Specific tours may have additional restrictions:
- 27 Waterfalls of Damajagua: Age 8-65 years, good physical condition
- Diving/Snorkeling: Must know how to swim, and have no breathing problems
- Safari 4×4: Pregnant women not allowed, back problems
- Water tours: Maximum weight 250 lbs (114 kg) for some activities
8.3 Customer Responsibility
It is your responsibility:
- Inform us of any relevant medical conditions when booking
- Bring any necessary personal medications.
- Arrive on time at the collection point
- Follow safety rules and guide instructions
- Respect the environment and local communities
9. Safety and Responsibility
9.1 Our Security Commitment
- All our tours operate with certified providers.
- Tour guides with valid licenses from the Ministry of Tourism
- Vehicles with liability insurance and up-to-date technical inspections
- Safety equipment maintained according to international standards
- Accident insurance included in all tours
9.2 Limitation of Liability
Paisa Tours RD will NOT be responsible for:
- Loss or damage to personal belongings during tours
- Injuries or accidents due to failure to follow safety instructions
- Delays or inconveniences caused by third parties (traffic, attractions, etc.)
- Additional expenses due to pre-existing medical emergencies
- Damages caused by negligent or reckless behavior of the customer
- Adverse weather conditions or natural disasters
- Personal decisions of the client during free time
9.3 Travel Insurance
- We include basic accident insurance during the tour
- We strongly recommend purchasing additional personal travel insurance.
- The included insurance does NOT cover pre-existing medical conditions.
- Coverage limited according to the terms of the current insurance policy.
9.4 Medical Assistance
- We provide basic first aid in case of minor emergencies
- For major emergencies, we coordinate transfer to a medical center
- Medical expenses are the responsibility of the client.
- It is vital to have international travel insurance that covers medical emergencies.
10. Code of Conduct
10.1 Expected Behavior
Customers must:
- Respect guides, staff, and other participants
- Do not consume excessive alcohol before or during tours
- Follow environmental rules (do not litter, respect fauna/flora)
- Respect cultural and historical sites
- Maintain appropriate and respectful behavior
10.2 Unacceptable Behavior
We reserve the right to expel without refund any customers who:
- Exhibit violent, offensive, or threatening behavior
- They are under the significant influence of alcohol or drugs
- Put your own safety or the safety of others at risk
- Deliberately damage property or equipment
- They harass staff or participants
- Violate local laws or park/attraction regulations
10.3 Minors
- Minors must be accompanied by a responsible adult at all times
- Parents/guardians are legally responsible for the conduct of minors
- Some tours require written authorization from parents/guardians
11. Photographs and Videos
11.1 Use of Images
- During the tours we may take photographs and videos for promotional purposes
- By participating, you consent to the use of your image in marketing materials.
- If you do not wish to appear in photos/videos, please inform the guide at the start of the tour.
- We do not sell individual customer images.
11.2 Client Photographs
- You may freely take personal photos (respecting the privacy of others).
- Use of drones requires special permits (not included)
- Some attractions restrict professional or commercial photography.
- Be respectful when photographing local communities
12. Lost and Found
- We are not responsible for items lost or left in vehicles/tours
- Report losses immediately to a guide or contact the office
- We will make a reasonable effort to locate lost items.
- Found items are kept for 30 days, then donated or discarded.
- Shipping costs for found items are the responsibility of the customer.
13. Complaints and Claims
13.1 During the Tour
- Report any problems immediately to your tour guide.
- Most problems can be solved on the spot
- Our goal is your complete satisfaction.
13.2 Post-Tour Complaints
If you are not satisfied:
- Contact us within 48 hours of the tour
- Email to [complaints@paisatoursrd.com] with reservation number and details
- We will investigate your claim and respond within a maximum of 7 business days.
- We seek fair solutions: partial refund, credit, or corrective measures.
13.3 Dispute Resolution
- We will attempt to resolve disputes in good faith through negotiation.
- If no agreement is reached, mediation will be sought from the Dominican Republic's tourism authorities.

14. Intellectual Property
14.1 Copyright
- All content on paisatoursrd.com (text, images, logos, design) is the property of Paisa Tours RD
- Protected by intellectual property laws of the Dominican Republic
- Reproduction, distribution or commercial use is prohibited without written authorization.
14.2 Permitted Use
Can:
- View and download material for personal, non-commercial use.
- Share links to our website
- Cite content with appropriate attribution
14.3 Registered Trademarks
- «"Paisa Tours RD" and associated logos are trademarks owned by us.
- Unauthorized use of our trademarks is prohibited.
15. Protection of Personal Data

Summary:
- We protect your information in accordance with Law 172-13 of the Dominican Republic
- We use data only for service provision and authorized communication
- We do not sell personal information to third parties.
- You can exercise your rights of access, rectification, and deletion

17. Force Majeure
We will not be liable for failure to perform our obligations due to circumstances beyond our reasonable control:
- Natural disasters (hurricanes, earthquakes, floods)
- Pandemics or health emergencies
- War, terrorism, or civil unrest
- Third-party strikes or labor disputes
- Infrastructure failures (power outages, internet, roads)
- Government decisions (closures, restrictions)
In these cases, we will offer rescheduling or a refund as appropriate.
18. Amendments to the Terms
18.1 Changes
- We reserve the right to modify these Terms at any time
- Significant changes will be announced on our website
- The "Last Updated" date will be changed
- Continued use of the site/services constitutes acceptance of changes
18.2 Applicable Version
- The Terms in effect at the time of your booking are those applicable to that transaction.
- Previous bookings are governed by Terms accepted at that time
19. Applicable Legislation
These Terms and Conditions are governed by the laws of Dominican Republic, including:
- Dominican Civil Code
- Law 84-99 on the Revaluation of the Tourist Zone
- Law 172-13 on the Protection of Personal Data
- Law 358-05 on Consumer Rights Protection
- Regulations of the Ministry of Tourism (MITUR)
19.1 Jurisdiction
Any legal dispute will be resolved in the competent courts of the Dominican Republic, specifically in the province where Paisa Tours RD operates.
20. General Provisions
20.1 Complete Agreement
These Terms, together with our Privacy Policy and booking confirmation, constitute the entire agreement between you and Paisa Tours RD.
20.2 Divisibility
If any provision of these Terms is declared invalid or unenforceable, the remainder will remain in full force and effect.
20.3 Resignation
Failure to exercise any right under these Terms does not constitute a waiver of that right.
20.4 Allocation
You may not transfer your rights or obligations under these Terms without our prior written consent.
20.5 Language
In case of conflict between versions in different languages, the Spanish version will prevail.
